A MAN charged with for the alleged rape of his mother walked out of the High Court in Suva yesterday, a free man.
The man was initially charged with two counts of rape.
Following the summing up, the assessors found the man not guilty on the first count of rape, but guilty on the second count of rape.
In his judgment, Justice Daniel Goundar said the man decided to remain silent during the trial.
He said the complainant in the case was 63 years-old and had advised the prosecution at one time that her son did not rape her, which he said, showed that the Prosecution failed to prove their case beyond reasonable doubt.
